Terms & conditions

These terms explain how Black Pastel provides website design, templates, monthly website plans, hosting, support, booking systems, ecommerce systems and custom website functionality.

They are here to make everything clear from the start, including ownership, licensing, payments, ongoing support, cancellation and how Black Pastel systems are used.

By purchasing a website, template, support plan, hosting plan or related service from Black Pastel, you agree to these terms.

Key information

We want clients to feel confident about what is included, what remains theirs, and how ongoing services are handled.

In simple terms, you own your business content and branding. Black Pastel retains ownership of the templates, systems and underlying code we create unless otherwise agreed in writing.

This means your website can be used as agreed under your project, hosting, support or monthly plan, but Black Pastel systems cannot be copied, resold, redistributed or reused elsewhere without permission.

Client content

Your logo, business name, images and written content remain yours.

Black Pastel systems

Templates, booking systems, admin areas, automation and custom functionality are licensed for use and are not sold unless agreed otherwise in writing.

Ongoing plans

Monthly plans cover hosting, maintenance, support, backups, updates and continued access to Black Pastel systems where included.

Commission

Black Pastel is not currently charging commission on standard websites being built now. Commission would only apply in future where specifically agreed in writing for certain booking systems, such as accommodation bookings.

Full terms & conditions

By purchasing a website, template, hosting, support plan or related service from Black Pastel, you agree to the following terms.

1. Ownership & intellectual property

All websites, templates, booking systems, admin systems, automation and custom-built functionality created by Black Pastel remain the intellectual property of Black Pastel unless otherwise agreed in writing.

Websites and systems are licensed for use, not sold. Clients are granted the right to use the website and any included systems while under an active hosting, support or maintenance plan with Black Pastel, where applicable.

Clients may not copy, reuse, resell, redistribute, share or replicate any Black Pastel website, template, system or code without written permission.

2. Client content

Clients retain ownership of their business name, logo, images and written content that they provide for use on their website.

Black Pastel may display completed work, screenshots or selected project examples in its portfolio, social media or marketing material unless otherwise agreed in writing.

3. Hosting, support & maintenance

Websites and systems provided by Black Pastel may rely on Black Pastel hosting, maintenance and support services to function correctly and securely.

If a client cancels hosting or support, some website functionality may no longer be available, particularly where the site uses Black Pastel systems such as booking forms, admin areas, automation or custom integrations.

Black Pastel is not responsible for issues caused by third-party providers, including but not limited to payment providers, domain registrars, email providers or service outages outside our control.

4. Setup fees

Setup fees cover the time required to design, build, customise and launch a website or system.

Setup fees are non-refundable once work has begun.

5. Monthly plans

Monthly plans cover services such as hosting, maintenance, backups, support, updates, security and continued licensing of Black Pastel systems where included.

Failure to pay ongoing monthly fees may result in suspension of the website, booking system, admin access or related services until the account is brought up to date.

6. Booking systems & online payments

Black Pastel may provide booking systems and payment integrations as tools for businesses to take bookings and payments online.

Black Pastel is not responsible for:

  • customer disputes
  • refunds
  • chargebacks
  • customer no-shows
  • incorrect information submitted by customers
  • payment processor fees

The client remains responsible for managing their business, bookings, customer communication and business policies.

7. Commission where applicable

Black Pastel is not currently charging commission on the standard websites and systems it is presently building.

In future, for certain specialist booking systems such as accommodation booking platforms, commission may apply where this has been clearly agreed in writing before launch.

Not all websites or systems are subject to commission.

8. Liability

Black Pastel is not liable for loss of business, loss of earnings, loss of data, downtime caused by third-party services, or security issues arising from weak client passwords, client misuse or actions outside our control.

While we always aim to provide secure and reliable services, no website or third-party service can be guaranteed to be completely uninterrupted or error-free at all times.

9. Termination

If a client chooses to stop using Black Pastel services, any license to use Black Pastel-owned systems, templates and functionality may end unless otherwise agreed in writing.

This may result in the removal or disabling of booking systems, admin systems, custom functionality or hosted services supplied by Black Pastel.

10. Acceptance of terms

By working with Black Pastel, purchasing a website or template, or using our services, you confirm that you have read and accepted these Terms & Conditions.
